The HamYad Foundation: Global Terms of Use & Security Conditions

Effective Date: March 2026 Our Mandate: The rule of law must prevail over the rule of force.

Welcome to the digital headquarters of The HamYad Foundation. By accessing our website, utilizing our secure communication channels, or interacting with our 5 Pillars of action, you agree to be bound by these Terms and Conditions. Because we operate in a high-security transitional justice environment, these terms are strictly enforced to protect our mission, our donors, and the architects of a free Iran.

1. Institutional Purpose & Disclaimer

The HamYad Foundation provides a secure ecosystem for cultural preservation, transitional justice archiving, and survivor empowerment. However, please note:

  • Medical Disclaimer: While our Wellness & Recovery Pillar facilitates access to tele-health professionals, this website itself does not provide direct emergency medical or psychiatric services. If you are in immediate, life-threatening danger, please contact local emergency resources or secure underground networks.

  • Legal Disclaimer: Information regarding the International Criminal Court (ICC) and our Justice & Memory Pillar does not constitute formal legal representation until a secure, encrypted intake process is completed with our vetted legal task force.

2. Security Rules & User Conduct

We maintain a zero-tolerance policy for digital hostility. Any attempt by state or non-state actors to breach these terms, compromise our data, or harass our users will be documented, forensically archived, and forwarded to international cyber-crime and human rights tribunals.

3. Intellectual Property: The Living Legacy Archive

The art, poetry, testimonials, and historical accounts curated within the Arts & Cultural Resistance Pillar and the Voices of Tomorrow archive belong to the Iranian people and the original creators.

  • Protection of Legacy: You may not copy, reproduce, or monetize any stories or artwork from this site without the explicit, secure permission of The HamYad Foundation. We fiercely protect the intellectual property of the fallen and will pursue legal action against any entity attempting to misappropriate these sacrifices.

  • Evidence Submission: By securely submitting evidence to our Justice Pillar, you grant the Foundation the right to encrypt, store, and utilize this data strictly for international legal advocacy and ICC submission.

4. Financial Compliance & OFAC Regulations

The HamYad Foundation operates with elite financial transparency and strict adherence to international law.

  • All financial contributions to our Livelihood & Future stipends and operational funds are processed in strict compliance with the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) General Licenses, as well as allied international banking regulations.

  • We reserve the right to refuse or refund any donation that cannot be verified or that originates from sanctioned state entities attempting to compromise our financial integrity.

5. Limitation of Liability: The "Shadow Ministry" Clause

To ensure the execution of our mission in high-risk environments, HamYad utilizes a dual-board "Shadow Ministry" structure. While our Global Advisory Board ensures strict governance, the Foundation, its directors, its anonymous operators, and its volunteers shall not be held liable for any direct, indirect, or incidental damages resulting from state-sponsored internet shutdowns, localized cyber-attacks, or the interception of communications by hostile telecommunications providers.

We strongly mandate the use of VPNs or Tor for users within high-risk zones.

6. International Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with international human rights frameworks and the legal jurisdiction wherein our global headquarters are formally incorporated, without regard to conflict of law principles.
